A core principle of Wayvers is the commitment to storing and processing all user data exclusively within the United States of America. By using our Services, you agree to the collection and use of information in accordance with this policy and specifically acknowledge and consent to all your data being stored and processed within the USA.

1. Information We Collect
We collect various types of information to provide, maintain, and improve our Services.
A. Information You Provide Directly to Us:
Account Information: When you create or update an account, we collect personal details such as your full name, email address, phone number, profile picture, login credentials (username and password), and payment information (e.g., credit card details).
Driver-Specific Information (for Drivers): This includes your driver's license information, vehicle registration details, proof of insurance, background check information (where permitted by law, including criminal record, driving history, and known aliases), and tax identification numbers (e.g., SSN, EIN).
Rider-Specific Information (for Riders): Saved addresses (e.g., Home, Work), preferred payment methods.
Communications: Information you provide when you communicate with us, drivers, or riders through our in-app messaging, customer support channels, or other means (e.g., content of messages, call recordings if you are notified in advance).
Ratings and Feedback: Information you provide when you rate or provide feedback on trips, drivers, or riders.
Identity Verification: Government-issued identification documents (e.g., driver's license, passport, which may contain identification photos, numbers, expiration date, date of birth, and gender) and user-submitted selfies.
Promotions and Surveys: Data you provide when participating in promotions, contests, or surveys.
B. Information Collected Automatically Through Your Use of the Services:
Location Data:
Precise Location: We collect precise location data from your mobile device when the Wayvers app is running in the foreground (app open and on-screen) or in the background (app open but not on-screen) if you have granted us permission. This is essential for matching riders with drivers, facilitating pickups, enabling navigation, and ensuring safety during a trip.
Approximate Location: We may infer your approximate location based on your IP address or other device information when precise location access is not granted or available.
Trip/Route Data: We collect information about the pick-up and drop-off locations, trip distance, routes taken, and timestamps of your trips.
Usage Information: We collect data about how you interact with our Services, including the features you use, the pages you view, the dates and times of your access, and referring/exit pages.
Device Information: We collect information about the devices you use to access our Services, including the device model, operating system version, unique device identifiers, IP address, mobile network information, and browser type.
Log Data: Our servers automatically record information when you use our Services, including IP addresses, browser type, internet service provider, referring/exit pages, and timestamps.
Cookies and Tracking Technologies: We use cookies and similar tracking technologies (e.g., web beacons, pixels) to track activity on our Services and hold certain information. To operate, maintain, and improve the functionality of our ride-hailing platform.

To match riders with drivers and facilitate navigation.

Between Riders and Drivers:
Riders' view of Drivers: First name, profile picture, vehicle make/model/color, license plate number, driver rating, approximate location during pickup, and real-time location during an active trip.
Drivers' view of Riders: First name, rider rating, approximate pickup location, and real-time location during an active trip. Your full address is only visible to the driver upon reaching the specified pickup/drop-off point.
Anonymized Communication: Our in-app communication tools are designed to protect your actual phone numbers.
Service Providers: We engage third-party service providers to perform services on our behalf, such as payment processing, background checks, data analytics, cloud hosting, customer support, and marketing. These providers are contractually obligated to store and process your data exclusively within the United States of America. They are also obligated to protect your information and use it only for the purposes for which we disclose it to them.
Affiliates and Subsidiaries: We may share information with our corporate affiliates and subsidiaries for business operations and service improvement. All such affiliates and subsidiaries are bound by this policy to store and process your data solely within the United States of America.
Legal Compliance and Protection: We may disclose your information if required by law, court order, or governmental authority (U.S. Federal or State), or if we believe it's necessary to:

A. In-App Privacy Settings (for both Riders and Drivers):
Location Data:
Precise Location Access: You can enable or disable precise location access for the Wayvers app at any time through your device's operating system settings. Note that disabling precise location may affect the functionality of the Services.
Background Location Tracking: You can control whether the app can access your location when it is in the background via your device settings.
Location History: View your past trip locations and routes within the app. You may have the option to delete specific trip history entries or anonymize data after a certain period (e.g., 90 days for detailed routes, while retaining necessary billing information).
Personalized Ads:
Opt-Out of Personalized Advertising: You can opt out of receiving personalized advertisements based on your trip history, order details (if applicable), and Browse activity within the app's privacy settings. Please note that even if you opt out, you may still see general or contextual ads that are not based on your personal data.
Data Sharing for Marketing/Analytics:
Opt-Out of Data Selling/Sharing: You have the right to opt-out of the "selling" or "sharing" of your personal information for cross-context behavioral advertising or similar purposes, as defined under applicable U.S. privacy laws (e.g., CCPA, CPRA). A "Do Not Sell or Share My Personal Information" link will be prominently displayed where required.
Communication Preferences:
Manage your preferences for marketing and promotional emails, SMS messages, and push notifications. You will continue to receive essential transactional communications (e.g., trip confirmations, safety alerts).
Profile Information Visibility:
Profile Picture: Control who can see your full profile picture (e.g., public, only to drivers/riders during a trip).
Driver-Specific: Drivers can review and update their vehicle information visible to riders.
B. Your Data Rights:
As a user whose data is stored and processed exclusively in the United States, you generally have the following rights regarding your personal data, subject to specific U.S. federal and state laws that may apply to you (e.g., California Consumer Privacy Act, Virginia Consumer Data Protection Act):

5. Data Retention
We retain your personal information for as long as necessary to provide our Services, comply with legal obligations (e.g., U.S. tax, audit, safety records), resolve disputes, and enforce our agreements.
Account Information: We retain your profile information for as long as you maintain an active account.
Trip and Transactional Data: We retain transactional information (e.g., rides, payments) for at least seven (7) years to comply with U.S. tax and accounting obligations.
Safety Data: Data related to safety incidents, fraud prevention, or legal claims may be retained for longer periods as required by U.S. law or necessary for the defense of legal claims within U.S. jurisdictions.
De-identified Information: We may retain de-identified or aggregated information for analytical purposes for extended periods. When we receive or use de-identified information, we maintain it in de-identified form and do not attempt to reidentify the information.

All personal data collected, processed, and stored by Wayvers and its authorized service providers is exclusively maintained within data centers and computing infrastructure located within the United States of America. This commitment ensures that your data remains subject to U.S. laws and regulations.
We utilize a network of secure data centers across various major U.S. data center hubs, including but not limited to, Northern Virginia, Phoenix, Dallas, and Chicago. Our selection of these locations is based on factors such as robust connectivity, reliable power, favorable climates, and strong security infrastructure.
8. Children's Privacy
Our Services are not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16 without verifiable parental consent, we will take steps to delete that information. If you believe we might have any information from or about a child under 16, please contact us.
9. International Data Transfers
Wayvers does not transfer or process user data outside of the United States of America. Our commitment to U.S. data residency means that all personal information remains within U.S. borders. If you are located outside the United States, by using our Services, you consent to your data being transferred to and stored in the United States.
10. Changes to This Privacy Policy
We may update our Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, and other factors. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Effective Date" at the top. We may also notify you through other means, such as email or an in-app notification. Your continued use of the Services after any changes indicates your acceptance of the updated Privacy Policy.
